These Terms and Conditions supplement our general Terms of Service and apply to the PWR Airdrop Program (the “Program”) operated by PWR Labs using the PWR Chain infrastructure. All references to terms defined in the Terms of Service apply here. By participating in the Program, you acknowledge that you have read, understood, and agree to comply with both the Terms of Service and these PWR Airdrop Program Terms and Conditions.
We reserve the right to amend these Terms and Conditions at any time. Should changes occur, the revised date at the top of this page will be updated, and where applicable, additional notice may be provided (such as via a notice on our website or direct notification). We recommend checking these Terms regularly to stay up to date with the latest information.
Program Overview
The PWR Airdrop Program introduces a points system that rewards active participants within the PWR Chain ecosystem. Points can be earned by completing various tasks or actions (“Eligibility Missions”), as defined and updated by PWR Labs. Participants will accumulate points in forms such as XP, Tokens, or Stars, which may be converted into $PWR tokens during the Airdrop claim period (subject to PWR Labs’ discretion). PWR Labs retains the right to adjust any aspect of the Program, including methods for earning points, the calculation of rewards, or the benefits provided, without prior notice to participants. No guarantee of any reward or benefit is made, even if points are accumulated.
Program Duration
The Program will commence on 6th September 2024 and will continue until a date determined by PWR Labs.
Points Visibility and Ranking
PWR Labs maintains a leaderboard that allows participants to view their points and rankings. To access this information, participants must log into their account via the Program portal.
Eligibility
To be eligible to participate in the Program, participants must adhere to these Terms and Conditions.
(A) The Program is open to individuals who are at least 13 years old at the time of entry.
(B) You acknowledge and agree that participation is not permitted if:
(1) Our geo-location systems identify you as being in a jurisdiction that:
(a) is under a U.S. government embargo,
(b) is classified as a “terrorist-supporting” country,
(c) faces heightened sanctions or restrictions from various governments or international bodies, or
(d) poses high risks associated with the Airdrop; or
(2) You are listed on any U.S. government or international blacklist of prohibited or restricted parties.
Prohibition on Automated Participation
The use of automated tools or methods to engage in the Program is strictly prohibited. PWR Labs reserves the right to disqualify any participant found to be using bots, scripts, or other automated systems to manipulate their participation in the Program.
No Guaranteed Rewards
PWR Labs is under no obligation to provide any rewards, even if participants have accumulated points. PWR Labs may withhold, modify, or cancel rewards at its discretion, and such actions are without liability. Rewards, including $PWR tokens, have no guaranteed value, and participation in the Program should not be construed as a promise of future value, benefit, or utility.
Non-Monetary Nature of Points
Points earned through the Program hold no intrinsic market value and cannot be traded or exchanged. The points are strictly for use within the scope of the Program and are not transferable to other users or external systems. Points are provided on an "as-is" basis, with no implied warranties regarding their value or usability.
No Endorsement by Third Parties
The Program is operated solely by PWR Labs, and no external parties, including social media platforms or any other organizations, are sponsors, administrators, or otherwise affiliated with this Program. If you have any questions about the Program, they must be directed to PWR Labs, not to any third-party site or platform.
Additional Conditions and Program Integrity
All decisions made by PWR Labs in relation to the Program, including participant eligibility, point allocation, scoring, and adherence to PWR Labs' standards, are final. PWR Labs reserves the right to make changes to these terms, including but not limited to those necessary to maintain the fairness of the Program or to address unforeseen circumstances (e.g., technical issues, acts of nature, or changes in legal regulations).
Limitation of Liability
To the fullest extent permitted by applicable law, PWR Labs, its affiliates, and their respective officers, employees, agents, and partners shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to damages for loss of profits, data, or goodwill, arising out of or related to your participation in the Program. PWR Labs’ liability is strictly limited to its administrative responsibilities regarding the Program, and by participating, you agree that you shall not assert any claim of monetary value for the points or rewards earned in the Program.
Participant Assumption of Risk
By participating in the Program, you acknowledge that blockchain technologies and digital assets carry inherent risks. These risks include, but are not limited to, loss of tokens, volatility in token value, technological failures, and regulatory changes. You assume full responsibility for these risks and waive any claims against PWR Labs arising from your participation in the Program.
Indemnification
You agree to indemnify and hold harmless PWR Labs, its affiliates, and their respective officers, employees, agents, and partners from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your participation in the Program, your violation of these Terms, or your infringement of any third-party rights.
Governing Law and Dispute Resolution
Any disputes arising from participation in the Program are subject to the provisions set forth in PWR Labs' Terms of Service, which include binding arbitration and a waiver of class action rights. All disputes must be resolved on an individual basis and may not be brought as part of any class or representative action.
Force Majeure and Program Suspension
PWR Labs reserves the right to modify, suspend, or cancel the Program in the event of force majeure, including but not limited to natural disasters, government regulations, strikes, war, or other events beyond its control. In such cases, PWR Labs shall not be responsible for distributing rewards or providing compensation to participants.
Privacy and Data Usage
PWR Labs may collect personal information related to your participation in the Program, including data necessary to track points and issue rewards. By participating, you agree that PWR Labs may use your data in accordance with the Privacy Policy, including for program administration and related communications.
Severability
If any portion of these Terms is deemed invalid or unenforceable, the remaining provisions will continue to be enforceable and effective. The invalidity of any provision shall not affect the validity of the remaining terms.
